Personal Data Protection Act — Privacy Policy

We, PCY Innovation Sdn. Bhd. (1266475-U) herein after (“PCY”, “chopchop”, “CC”, “we”, “us”, or “our”) respects the right to privacy of our customers, herein after (“customers”, “users”, “you”).

This Privacy Police Notice is open to all our customer customers, prospective customers and/or any person who browse use access visit our website (http://www.pcyinnovation.com.my”, “http://chopchop.asia”, “http://www.chopchop.com.my”) and/or our mobile applications with the name of ChopChop Mobile App, ChopChop Merchants or such other names so determined by us from time to time.

  • We are committed to safeguarding your privacy and ensuring that your personal data is protected.
  • We will limit the collection and use of customers information to the minimum as may be required to deliver superior service to our customers, which includes advising our customers about our products, services and other opportunities, and to administer our business.
  • We will permit only authorized employees, who are trained in the proper handling of customer information, to have access to that information.
  • Whenever we hire other organizations to provide support services, we will require them to conform to our privacy standards.

This Notice describes how we process (includes collect, record, hold or store) your data and your rights with regards to your data that is being and/or will be, collected, processed and retained by us. We therefore make sure that our policies and practices in relation to personal data comply with the requirements of the Personal Data Protection Act 2010 (“PDPA”) under the laws of Malaysia.

  1. Collection of Personal Data

The information we collect is information that we require in order to perform our services and offer our products to you. This information is similar to the information typically collected by us on the application forms, which include, but not limited to, your name and address details, date of birth, identification number, details such as telephone number and others.

You may choose to give us personal information directly in a variety of situations. For example, you may want to give us your name and contact information to communicate with you to register for a service, to provide you with a subscription, or to do business with us if you are a supplier or business partners.

From time to time, we may also collect information that pertains to you indirectly through other sources (if any). When we do so, we require the third party to confirm that the information was legally acquired by them and that we have the right to obtain it from them and use it. The information that we collect, either directly or indirectly, may be combined to help us improve its overall accuracy and completeness and to help us better tailor our interactions with you.

  1. Nature of Personal Data

Examples of Personal Data CC may collect directly and/or indirectly from you:

  • Full Name, Age, Gender, Date-of-Birth, Malaysia Identification Card Number, Passport Number;
  • Race, Ethnic Origin, Nationality;
  • Contact Information including address, email address, phone number;
  • Marital Status

Failure to obtain and/or verity your personal data will lead to the following:

  • CC may not be able to provide you with updates in relation to CC services and promotions;
  • CC may not be able to provide you with any notice, services in which you have requested;
  • CC may not be able to provide you important security updates, bug fixed
  1. Purpose use of Personal Information

C1. Provision of Services

  • Creation and maintenance of your CC Account;
  • Fulfilling your transaction request;
  • Facilitation of all transactions between you and the Merchant;
  • Your identification as CC Account user;
  • Personalizing your experience on our website and/or mobile sites;
  • Notification of payment status, order notification and confirmations, account balance, point collected, security or support and maintenance advisories, changes on Terms of Use and such other administrative notification;
  • Redemption of CC rewards, point, cash back, bonus
  • Responding to your query and request

C2. Merchant Services & Products

  • Delivery or facility the delivery of the services or products by the Merchants;
  • Facilitation of communication between you and the Merchant and/or CC

C3. Marketing and Promoting

  • Promotion of our services and/or products and services;
  • Research, benchmarking and statistical analysis of our Services;
  • Promotion of products and services we think may be of interest to you;
  • Improve, personalise and customize the quality of experience when you use our Services;
  • Delivery of offers and promotional materials related to our Services and for other marketing purposes;
  • Tracking of user-specific information on accessed or visited pages

You may at any time inform us if you do not wish to receive marketing communications from us or our related corporations by contacting us directly.

When CC wish to share your information with its Business Partners for marketing and promotional purposes, CC will only disclose your personal information such as your username, date-of-birth, age, religions, activities behaviour, email address to our Verify Business Partners.

C4. Record and Administration

  • Internal record keeping;
  • Improve administration of our Services and/or Products;
  • Operation and administrative purposes including account management, billing and collection, internal and/or external audits;
  • Compliant handlings;
  • Security purposes;
  • Internal and/or External Verified Staff training purpose

C5. Legal Compliance

  • Conducting of customer due diligence;
  • Prevention, hindrance, reporting of any crime or possible criminal activities including but not limited to fraud, suspicious actions, bribery and money laundering;
  • Compliance to any legal or regulatory requirement relating to the provision of our Services and/or Products;
  • Enforcement or defending our legal rights and/or obtaining legal advice

C6. Protect the Rights and Property of CC and Others

We may also use or share your information to protect the rights or property of CC, our business partners, suppliers, clients, or others when we have reasonable grounds to believe that such rights or property have been or could be affected. In addition, we reserve the right to disclose your personal information as required by law and when we believe that disclosure is necessary to protect our rights, or the rights of others, or to comply with a judicial proceeding, court order, or legal process served on our websites and/or our mobile application (Android / iOS).

  1. Collection and Use of Non-Personal Information

We also collect non-personal information/data in a form that does not permit direct association with any specific individual. We may collect, use, transfer and disclose non-personal information for any purpose.

The following are some examples of non-personal information that we collect and how we may use it: We may collect information such as occupation, language, postcode, area code, unique device identifier, location and the time zone where the CC products or services are used, so that we can better understand customer behaviour and improve our products, services and advertising.

We also may collect information regarding customer activities on our websites and / or our mobile application (Android / iOS / Other Mobile Platform) and from our other products and services. This information is aggregated and used to help us provide more useful information to our customers and to understand which parts of our websites, products and services are of most interest. Aggregated data is considered non-personal information for the purposes of this Privacy Statement.

If we do combine non-personal information with personal information the combined information will be treated as personal information for as long as it remains combined.

  1. Disclosing Your Personal Information

We commit to ensure your personal data with us will be kept confidential. Your personal data with us shall remain private and not disclosed or used by any third party, but you hereby consent and authorize CC to disclose your personal data save for the following categories of third parties:

E1. Related Companies

We may disclose and/or share your personal data with our associates, subsidiary and/or related companies for internal record, administration and operation purposes. Our related companies are required to comply with this Notice.

E2. Third Party Service Providers

We may disclose and/or share your personal data with our sub-contractors or third-party vendors, third-party service or product providers, who may be located within or outside Malaysia, who provide outsourcing services to us including accounting services, technology development and management, sales and marketing activities.

E3. Business Partners

We may disclose and/or your personal data with our payment gateway service providers, logistic partners, Merchants and such other parties who require to facilitate the provision and supply of our Services and/or Products to you.

E4. Consultants

We may disclose and/or share your personal data with our auditors, business consultants, accountants, lawyers or other professional advisers and/or consultants.

E5. Competent Authorities

We may disclose and/or share your personal data any person to whom we are compelled to or required under law or in response to a local or state or federal authority, industry regulator, enforcement agency, statutory authority, court of laws, tribunal, arbitration centre, commission or council or association legally authorized by law.

E6. Third Party on Direction

We may disclose and/or share your personal data with any persons directed by or consented to by you. This may include sharing of your activities on your social media sites.

We do not share your personal data with advertisers. However, if you interact with certain advertisements, the advertisers (or the company which the advertiser works with, for example, its advertising agency or an advertising network) may determine certain characteristics about you as such advertisements are directed at certain group of users. For examples users within certain age group, gender, interest and/or certain geographic location.

  1. Retention, Security and Accuracy of Personal Data

CC takes precautions including administrative, technical and physical measures to safeguard your personal information against loss, theft and misuse, as well as against unauthorised access, disclosure, alteration and destruction. Furthermore, we intend to protect your personal information and to maintain its accuracy. CC implements reasonable physical, administrative and technical safeguards to help us protect your personal information from unauthorized access, use and disclosure.

CC makes it easy for you to keep your personal information accurate, complete and up to date. We will retain your personal information for as long as your account is active or as needed to provide you services.

  1. Access and Correction to Your Personal Data

Under Personal Data Protection Act 2010 (“PDPA”), you reserve the right to access your personal data and request for correction of the personal data that might be inaccurate, obsolete, incomplete or misleading.

To access your personal data, you can:

  • Request to check and access your personal data in our records;
  • Request that we correct any of your inaccurate, obsolete, incomplete or misleading personal data; and
  • Request copies of the data from us.

Once we receive a request, we will acknowledge the receipt of such request. For data amendment and correction, we will consider if the information requires amendment. If there is any disagreement, then we specify the reason in clearly stated terms such as where rights of others will be violated, or regulatory functions will be affected.

CC reserves the right to decline to process requests:

  • Where CC is not supplied with sufficient information as to the identity of the requestor or of the relevant person making the request;
  • Where CC is not supplied with sufficient information to enable it to locate the personal data;
  • Where the burden or expense of providing access is not proportionate to the risk of the data subject’s privacy;
  • Where CC cannot comply with the request without disclosing the personal data of another individual who is identifiable from that information. However, this can be provided if CC is satisfied that the other individual has consented to the disclosure of the information to the requestor or it is reasonable in all circumstances to comply without the consent of such other individual;
  • The processing of personal data is controlled by another data user in a manner which prohibits the relevant data user from complying in whole or part with the request;
  • Where it will be against any court order;
  • Where it will disclose confidential commercial information; or
  • Where the access is regulated by another law.

Access, correction, deletion requests or any enquiries and complaints can be made (i) online via CC Websites; or (ii) by contacting CC Customer Careline at +6011-59954829; or (iii) by visiting the nearest CC Offices. CC will use reasonable efforts to comply with your request to access or correct your personal information within 30 days of receiving your request to change the same and charge the relevant processing fee (if any).

If you wish to request that we no longer use your personal data or limit the usage of your personal data in anyway whatsoever, you may contact us at mychopchopmarketing@gmail.com . However, please note that CC may not be able to proceed with the provision of the relevant product or services and you may not be able to use such product and services thereafter

The personal data requested by CC are mandatory for the relevant product or services which you must provide and agree to the processing of such personal data. Should you decide not to provide any or all of the personal data, CC may not be able to proceed with the provision of the relevant product or services and you may not be able to use such product and services thereafter.

  1. Your Obligation Regarding Your Personal Data

You are responsible for providing accurate, not misleading, complete and up-to-date information to CC about yourself and any other person whose personal information you provide us and updating this personal data as and when it become inaccurate, misleading, incomplete and out-of-date by contacting CC.

  1. Your Consent

In enjoying benefits of CC’s Services and/or Products, your consent to the collection and use of the personal data by us in the ways described hereinabove, which may change time-to-time unless and until you inform CC to the contrary.

We may amend, modify or vary the provisions in this Notice, including the mode of processing, purposes of processing as well as our retention and security policy in relation to your data from time to time. A reasonable prior notice will be served to you. By continuing using, accessing and utilizing the Services and/or Products after the effective date of such amendments, modifications or variations of this Notice, you shall be deemed to have consented to the same.
